Fully comply with Law 13.756/2018, Decree-Law 3.688/1941 and all applicable regulations.

1. Introduction and Acceptance of Terms
Welcome to the SÓ PITACO Affiliate Program! This document establishes the rules, responsibilities and benefits for affiliates who wish to promote our recreational platform.
By signing up as an affiliate, you declare that you have read, understood and fully accepted: (a) these Affiliate Program Terms; (b) the SÓ PITACO Terms of Use; and (c) the Privacy Policy.

2.2 Commission Structure

Exclusive Currency: All commission amounts are calculated and paid EXCLUSIVELY in Brazilian Real (R$ / BRL). We do not operate with other currencies.

Important: All amounts are calculated and paid exclusively in Brazilian Real (R$ / BRL).
💰 Advantage: Bonuses are retroactive! Upon reaching 100 referrals, the affiliate receives R$ 0,50 for each of the 100 Premium referrals, totaling R$ 50,00.
Anti-Pyramid Declaration
The SÓ PITACO Affiliate Program does NOT constitute a multi-level marketing system, pyramid scheme or any structure that depends on continuous participant recruitment.

3. Eligibility and Requirements
3.1 Basic Requirements
To participate in the program, you must:
- Be 18 years or older
- Have an active account in good standing on SÓ PITACO
- Provide true and updated information
- Have a valid and verified Wise account to receive payments
- Expressly agree with all terms of this document
📋 Validation: We reserve the right to request supporting documentation at any time.
3.2 Automatic Exclusions
The following will NOT be accepted as affiliates:
- ❌ Individuals or companies involved in illegal activities
- ❌ Sites or profiles that promote content about violence, hatred, discrimination or similar
- ❌ Betting houses, gambling operators or platforms that facilitate money betting
- ❌ People who organize paid competitions or promote irregular use of the platform
4. Commission Payment Process
4.1 Payment Cycle
During and after Mundial 2026, until the final payment of bonuses (if applicable).

Stage 1: Accumulation (immediate)

Stage 3: Payment (monthly)
- • Processing by the 15th of the following month
- • Transfer to your Wise account

4.3 Minimum Payment Amount

4.4 Payment Methods

4.6 Financial Reconciliation
Affiliate Responsibility
It is your responsibility to verify your statements and commissions monthly in the dashboard. Discrepancies must be reported immediately.
Deadline for Disputes
You have up to 15 days after each payment processing to dispute amounts. After this period, amounts are considered correct and accepted.

4.7 Retention or Blocking Situations

5. Conditions, Restrictions and Prohibited Practices
5.1 Prohibited Practices
The following practices result in immediate suspension and loss of commissions:
Identity Fraud

- • Using false or third-party identity
- • Forging documents
Payment Fraud
- • Using cards without authorization or cloned or stolen
- • Creating fake accounts to generate commissions
- • Any form of system manipulation
Spam and Abusive Marketing
- • Sending unsolicited emails (spam)
- • Making excessive posts in forums/groups
- • Using bots or automation for promotion
- • Buying fake traffic or fraudulent clicks
Brand Violation
- • Registering domains with "sopitaco"
- • Using SÓ PITACO brand in paid ads
- • Modifying logos or official materials
- • Creating fake profiles in platform name
5.2 Marketing and Promotion Rules
What is ALLOWED
You may promote SÓ PITACO as a recreational platform for predictions and competitions among friends about Mundial 2026.
Express Prohibitions
It is PROHIBITED to use the following terms or contexts:
- • Betting, gambling, bookmaker
- • Make money, guaranteed profit, financial return
- • Investment, multiply your money
- • Pyramid schemes or multi-level marketing
- • Promises of easy or quick earnings
- • Comparisons with betting houses
- • Encouraging addiction or compulsive gambling
- • Any language suggesting money betting
Email Marketing Rules
If you use email marketing, you must:

- • Using emails obtained from scraping/crawling
- • Sharing lists between affiliates
Consequences
Using purchased lists or spam results in immediate ban without right to pending commissions.
5.3 Use of Trademarks and Intellectual Property
Platform Rights
All rights to name, trademark, logo, design and content of SÓ PITACO belong exclusively to us.
Prohibited Uses
You CANNOT:
- Register domains containing "sopitaco" or variations
- Use trademark or logo in paid campaigns (Google Ads, Facebook Ads, etc)
- Modify, alter or create derivatives of our materials
- Use trademark in way that suggests non-existent official association
- Register social media profiles with "SÓ PITACO" in name
- Create content that depreciates or harms our reputation
Commission Invalidation
Commissions generated through trademark violation are automatically invalidated:
- • Traffic from unauthorized domains
- • Clicks from paid ads with our trademark
- • Referrals from fake profiles in our name
Besides losing commissions, you may be held liable for damages.
Permitted Uses
You CAN:
- • Mention "SÓ PITACO" in organic content (posts, videos, articles, etc)
- • Use platform screenshots in honest reviews
- • Include "SÓ PITACO Affiliate" in your bio/description
5.4 Monitoring and Audit
We reserve the right to monitor all affiliate activities through:

5.5 Progressive Penalties
1st Detection (Minor Infractions)
Formal warning by email with 48h deadline for correction
2nd Detection or Moderate Infractions
- • Temporary suspension of 30 days
- • Block new commissions during suspension
- • Validated commissions are paid normally
- • Recurrence results in permanent ban
Fraud, Spam or Serious Violations
- • Immediate permanent ban
- • Loss of ALL commissions (pending + available)
- • Possible communication to competent authorities
- • Reserve right of action for moral/material damages
⚖️ The penalties applied are exclusively determined by the platform within the administrative scope, and no internal appeal is permitted.
5.6 AFFILIATE PREMIUM LIST - SPECIFIC RULES
WHAT IS THE AFFILIATE PREMIUM LIST?
EXCLUSIVE administrative tool for affiliates that automatically adds your paying referrals to a personalized recreational list.
It is expressly prohibited for affiliates to promote the Premium Affiliate List as a product, exclusive benefit, or competitive advantage associated with the use of their referral link. The list is intended solely for the administrative management of the affiliate’s own referrals for internal purposes, and its existence must not be presented as an incentive for acquisition, a referral reward, or any form of differentiated benefit to the end user.
How it works:

- 2. That person upgrades to Premium access
- 3. They are automatically added to your Affiliate Premium List
- 4. You can organize recreational competitions with this group

Absolute Prohibition: Rankings Linked to Prizes
Strict Rule
Any prize eventually given by users or affiliates must occur spontaneously and randomly, and CANNOT BE LINKED to performance, rankings or prediction results within the platform.

- ✅ Draw among all users (not just top performers)
- ✅ Rewards for social engagement (not predictions)
Legal Justification
The prohibition of rewards linked to ranking is based on multiple concurrent legal grounds: (1) Law 14,790/2023, which reserves the operation of betting activities involving monetary prizes to operators licensed by SECAP/MF — a license that the platform does not possess and does not claim to possess; (2) Article 50 of Decree-Law 3,688/1941, which classifies the operation of games of chance involving entry fees and prize offerings as a criminal misdemeanor; and (3) Article 104 of the Brazilian Civil Code, which may invalidate contracts whose object is unlawful. The creation of ranking lists with paid entry and prize distribution based on position, even when organized externally by an affiliate, uses the platform’s infrastructure as an essential element of a potentially unlawful activity, which may constitute platform participation by omission — a risk this clause seeks to prevent and from which the platform expressly distances itself.
⚖️ Violation of this rule results in permanent ban, total loss of commissions and possible report to competent authorities.

SÓ PITACO is an independent project developed for recreational purposes and has no connection, authorization, partnership or affiliation with sports federations, competition organizers or official football entities.
Non-Affiliation Statement
- We are not affiliated with, authorized by or endorsed by any national or international sports federation
- We do not hold any license, partnership or commercial agreement with sports competition organizers
- We do not represent football clubs, athletes, agents or any entity related to professional football
- We do not sell official products, tickets or any material licensed by sports entities
- We do not use registered trademarks of sports entities in an unauthorized manner or in a way that suggests an official partnership
Informational Use
Any reference to competitions, teams or sports results is made exclusively for informational and recreational purposes, within the right to freedom of expression and information.
⚠️ Affiliates may not suggest or create the impression that SÓ PITACO has any official connection with sports entities, under risk of immediate ban and loss of all commissions.
5.8. User Responsibility and Independence
Declaration of Independence and Non-Intermediation
The SÓ PITACO platform does not organize, intermediate or participate in any paid competitions, bets or financial activities between users. Any initiative carried out by users or affiliates outside the platform, including private groups, social networks or messaging apps, is the sole responsibility of its organizers.
The platform acts EXCLUSIVELY as a technological tool for recreational social interaction about football.
Unauthorized External Activities
Affiliates and users CANNOT use the SÓ PITACO platform as a base or facilitator for organizing external activities that involve:
- • Groups on WhatsApp, Telegram or Discord
- • Communities on social networks (Facebook, Instagram, etc.)
- • Independent forums or websites
- • Third-party applications
- • Any unofficial communication channel
- 🚫 Organization of money bets
- 🚫 Paid pools or fee-based competitions
- 🚫 Paid VIP or premium groups
- 🚫 Sale of predictions or analyses
- 🚫 Any commercial activity related to sports results
Affiliate's Individual Responsibility
The affiliate is solely responsible for their promotional activities and for complying with applicable legislation in their jurisdiction, including laws on betting, gambling and consumer protection.
The affiliate is responsible for acts of third parties who use their referral link or participate in groups/communities organized by the affiliate.
The SÓ PITACO platform has no control, participation or responsibility over activities carried out outside the official platform environment.
Total Liability Exemption
SÓ PITACO shall not be liable, under any circumstances, for damages, losses, lawsuits or investigations arising from unauthorized activities carried out by affiliates or users on external platforms.
⚖️ Affiliates identified in unauthorized activities will be immediately banned, will lose all commissions and may be reported to competent authorities.
5.9. Indemnification and Hold Harmless Clause
Obligation to Defend, Indemnify, and Hold Harmless
The Affiliate agrees to defend, indemnify, and hold harmless the SÓ PITACO platform, its administrators, collaborators, and partners from any claim, legal or administrative action, regulatory investigation, penalty, fine, damage, cost, or expense (including reasonable attorneys’ fees) arising from or related to:
(a) violation by the Affiliate of any provision of this Agreement or the Terms of Use;
(b) use of the platform infrastructure (lists, rankings, or point systems) for betting purposes, games of chance, or any form of ranking-based prize distribution involving the collection of money from third parties;
(c) false statements, omissions, or misrepresentations made by the Affiliate in promotional or disclosure communications;
(d) violation of Law 14,790/2023, Article 50 of Decree-Law 3,688/1941, or any other regulatory rule committed during the performance of affiliate activities;
(e) any third-party claim arising from Affiliate activity that exceeds the limits authorized by this Agreement.
Survival of the Obligation
The indemnification obligation set forth in this clause shall survive the termination or expiration of this Agreement for any reason and shall remain valid and enforceable regardless of the reason for the termination of the contractual relationship.
Platform Control of the Defense
The platform reserves the right to assume exclusive control of the defense in any matter subject to indemnification by the Affiliate, in which case the Affiliate shall cooperate with the platform in presenting any available defenses, without relieving the Affiliate of its indemnification obligations.

6. Validation and Chargeback Handling
6.1 Validation Process
All commissions go through rigorous validation process before being released:

Right of Withdrawal: Already Exercised Before Payment
How the Platform Model Works (Art. 49, Brazilian Consumer Protection Code)
The user accesses the Premium plan for free during a trial period — with no charges and no credit card required.
During the trial, the user can use all Premium features and decide, with full knowledge of the service, whether or not to subscribe.
Only after the free trial ends are the payment buttons displayed. Therefore, payment is a conscious, voluntary, and informed act.
Legal Consequence
Article 49 of the Brazilian Consumer Protection Code (Law 8.078/1990) guarantees the right of withdrawal within 7 days for services contracted outside a commercial establishment. In this platform’s model, this right is offered even more broadly: the user can fully test the Premium service before any charge occurs, and may abandon it at no cost throughout the entire trial period. By completing the payment, the consumer unequivocally expresses approval and acceptance of the service, thereby exhausting the legal right of withdrawal provided by law.
⚠️ Any Chargeback After the Trial Period Is Considered Improper
Since the legal right of withdrawal is fully offered before payment — through a free trial period with complete access to Premium features — any chargeback requested after subscription will be treated as improper and potentially fraudulent, as the paying user already knew and approved the service at the time of purchase.

These evidences will be submitted to the card issuer and the appropriate authorities in case of improper dispute.
Definition
Chargeback is when customer disputes payment with bank/card operator, resulting in amount reversal. Deducting amount from seller and returning to buyer.
If there is chargeback:
- • Related commission is automatically cancelled
- • If already paid, will be deducted from future commissions
- • Affiliate is NOT held liable if acted in good faith
If affiliate accumulates multiple chargebacks or above 0.75% in 30 days:
- • Account enters priority analysis
- • Commissions held until investigation
- • Possible temporary suspension
- • If fraud confirmed: ban + loss of commissions
ATTENTION: High chargeback rate indicates low-quality traffic or fraud.
You must:
- • Promote only to legitimate audience
- • Not encourage fraudulent subscriptions
- • Report suspected misuse
- • Maintain traffic quality
6.3 Commission Retention Scenarios
Commissions may be preventively retained in following situations:
Improper/Fraudulent Chargeback
Customer disputes payment with bank/operator claiming fraud, non-recognition, etc.
⚠️ If affiliate has 0.76% or more chargebacks in 30 days: Preventive suspension + full investigation + possible ban.
Terms violation by affiliate
Misuse of Premium List, promotion as betting site, organizing paid competitions, spam, fraud.
All commissions (pending + available) may be retained as compensation.
Systemic fraud investigation
Identification of organized scheme (sets of multiple fake accounts, bots, cloned cards, etc).
Judicial determination or authority order
Block by court order, request from regulatory authority or other competent authority.
Total retention until process resolution. Affiliate will be notified when legally allowed.
Compensation Rules
If retention due to chargeback or refund, platform may deduct amount from future commissions until full compensation.
If insufficient future commissions, affiliate is NOT obligated to reimburse (except in cases of proven fraud).
⚠️ IMPORTANT: The preventive withholding of commissions during investigations shall have a maximum duration of 90 days, extendable for an equal period upon duly justified grounds communicated to the affiliate. Once the investigation is concluded without any confirmed irregularity, the retained amounts shall be fully released in the next payment cycle.
6.4 Chargeback Risk Periods
That's why we keep commissions "AWAITING RELEASE" for 30 days for PIX and bank slip and 90 days for credit cards and digital wallets before releasing them for payment.
7. Liability Limitations
Liability Exemptions
SÓ PITACO platform is NOT responsible for:

- No earnings guarantee: There is no promise or guarantee of minimum profit
- Result depends on effort: Success depends on quality and quantity of your promotions
- No employment relationship: Affiliates are independent partners, not employees
- Program may change: Terms, amounts and conditions may change per Section 9
7.2 Damage Exclusion
We are not responsible for any damages:
- • Loss of commissions due to terms violation
- • Chargebacks from referred users
- • Problems with payment method
- • Lost profits or lost opportunity
- • Moral damages from suspension/ban
- • Losses with marketing materials
7.3 Liability Limit
Under any circumstances, our maximum liability is limited to total amount of commissions owed and unpaid to affiliate.
7.4 Force Majeure Cases
We are not responsible for delays or failures caused by:
7.5 Default Charges
In case of amounts owed by affiliate to platform (e.g.: improperly received commissions, proven fraud), the following apply:

✅ Exceptions: Charges do not apply in situations of proven good faith, system error or preventive retentions later reversed.
7.6 Waiver of Class Actions
By accepting these terms, affiliate waives the right to:
- ⚖️ Participate in class actions against platform
- ⚖️ Join group litigation related to affiliate program
- ⚖️ Request compensation for collective moral damages
- ⚖️ Seek reparations exceeding owed commission amount
- ⚖️ Claim lost profits for expectation of future earnings
Any disputes will be resolved individually according to forum and legislation established in Section 10.

9.1 Right to Modify
We reserve the right, at any time, to:
- Change terms, conditions and commission amounts
- Adjust bonus structure and payments
- Temporarily suspend program
- Permanently terminate program
9.2 Program Termination
Voluntary Termination
If we decide to terminate program:
- • We will notify 30 days in advance
- • Valid and available commissions will be paid
- • Affiliate links will stop working
Force Majeure Termination
In exceptional cases (court order, technical impossibility, etc):
- • Program may be terminated immediately
- • We will do our best to pay validated commissions
- • We are not liable for resulting damages
9.3 End of the Program
The program ends naturally with the start of the last Round of 16 match of Mundial 2026, as from that moment on, the purchase of Premium access will no longer be allowed.
- • New referrals no longer generate commissions
- • Validated commissions are paid normally
- • The upcoming payment cycles will proceed as usual, and the last one will not have a minimum amount
- • Affiliate links are deactivated

📋 YOUR OBLIGATIONS
If users request organizing betting/paid competitions, report immediately
Respond promptly to clarification requests
If conducting giveaways, maintain documentation proving spontaneous nature
Keep promotional communications for at least 5 years
⚖️ COMMUNICATION TO AUTHORITIES
If we identify irregular use that may constitute crime or criminal misdemeanor, we will communicate IMMEDIATELY:

You have read, understood and agree with ALL terms of this document, including Premium List restrictions and Compliance Monitoring.
You understand SÓ PITACO is recreational entertainment platform and commit to promote it EXCLUSIVELY as such.
You commit to NOT present platform as betting tool, NOT organize paid competitions and NOT use Premium List for irregular purposes.
You are aware of active monitoring and agree with audits, documentation provision and cooperation with investigations.
You are AWARE that irregular use may result in suspension, loss of commissions, communication to authorities and civil/criminal liability.
