1. Introduction and Acceptance

Welcome to SÓ PITACO (hereinafter "Platform", "Service", "we", "our"). These Terms of Use ("Terms") govern your access to and use of our recreational predictions platform.

By creating an account, accessing, or using any part of the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use our Service.

🎮 Entertainment Only: This is an unofficial platform for recreational predictions among friends for fun. We do NOT conduct real-money betting and have no affiliation with official football organizations.
🚫 Not Affiliated: We are not affiliated, sponsored, or endorsed by any official football entity. This is an independent entertainment platform.
🔞 Minimum Age: Participation of minors under 18 depends on authorization and supervision by parents or legal guardians, who, by completing the registration, expressly declare that they are aware of and authorize such use. The platform adopts reasonable control measures, with parental supervision being the primary safeguard for the proper use by minors.
💳 Single Payment: Premium access requires a one-time, non-recurring payment valid until July 31, 2026.

2. Definitions

For the purposes of these Terms, the following definitions apply:

Unlimited Lists	Feature available to Premium users that allows the creation of an unlimited number of customized recreational lists, adding participants manually (one by one) for friendly competitions among friends, family, coworkers, etc.
Affiliate Premium List	Exclusive administrative tool for Affiliate Program participants that facilitates the management of their paying referrals by automatically adding them to a recreational list. Intended EXCLUSIVELY for recreational entertainment purposes. Its use for betting, paid competitions or any irregular commercial activity is PROHIBITED.
Recreational Use	Use of the platform exclusively for personal entertainment, fun among friends/family, and friendly competitions WITHOUT involving money betting, mandatory prizes or any form of gambling. Recreational use is the ONLY permitted purpose of the platform.

3. Service Description

UNDERSTANDING THE PLATFORM LISTS

1 Unlimited Lists (Premium Users)

What it is: Premium feature that allows the creation of multiple recreational competitions.

Who has access: Any user who purchases Premium access (affiliate or not).

Limit: Unlimited - create as many lists as you want!

How it works: You create a list and add participants manually (one by one).

Purpose: Organize multiple recreational competitions with different groups (e.g., one list for family, another for friends, another for coworkers, etc.).

Premium Advantage: Flexibility to organize multiple recreational groups simultaneously.

2 Affiliate Premium List (Exclusive to the Affiliate Program)

What it is: Exclusive administrative tool for participants of the Affiliate Program who are also Premium members.

Who has access: ONLY approved affiliates (not available to regular Premium users).

How it works: Unlike the other list, this one AUTOMATICALLY adds all users who registered through your affiliate link AND purchased Premium access, since only Premium users can access lists.

Purpose: To facilitate administrative management of the affiliate’s paying referrals, allowing them to organize recreational competitions with their audience more efficiently.

MANDATORY LEGAL RESTRICTIONS

🚫 PROHIBITED to charge for participation in this list or create "paid VIP groups"
🚫 PROHIBITED to award prizes based on ranking (unless it is a spontaneous prize not linked to prior payment)
🚫 PROHIBITED to use it to organize money betting or any form of gambling
✅ ALLOWED to use exclusively for recreational entertainment, communication with your audience and friendly competitions

CONSEQUENCES OF MISUSE: Use of this tool for betting, paid competitions or illegal activities will result in immediate suspension from the affiliate program, forfeiture of all commissions and possible civil and criminal liability under applicable law.

IMPORTANT: Scoring is based EXCLUSIVELY on sports knowledge and prediction strategy. There are no elements of luck or chance that characterize gambling. Points have no monetary value and are for recreational fun only among participants.

3-A. Legal Nature of the Platform and Distinction from Betting

Formal Statement: SÓ PITACO is NOT a betting operator

1 Platform Definition

SÓ PITACO is a digital recreational entertainment platform based on predictions about the outcomes of football matches. The platform is NOT, and does not intend to be, a fixed-odds betting operator under Law 14.790/2023 and the regulations of the Secretariat of Prizes and Betting of the Ministry of Finance (SECAP/MF).

2 Elements Supporting the Legal Distinction

(a) Absence of Financial Prize

The platform does not offer, promise, distribute, or intermediate any prize in money, goods, or valuables tied to the user’s performance in the prediction tournament.

(b) Payment for the Service, Not for Betting

The amount paid for Premium access compensates access to digital features (unlimited lists, personalization, expanded ranking) and does not constitute entry into a prize competition.

(c) Absence of Random Chance Operated by the Platform

The platform does not organize or intermediate draws, lotteries, or chance-based events — it merely records predictions freely made by the user regarding external and independent sports events.

(d) Informational and Recreational Nature

The scoring generated by the platform has an exclusively recreational and social purpose, without any intrinsic economic value.

3 Regulatory Framework

The operational model of SÓ PITACO is legally similar to what are commonly called "knowledge-based fantasy sports" (games of skill and sports knowledge), a category distinct from fixed-odds betting in multiple jurisdictions. However, the platform does not claim any specific regulatory ranking within this category and operates under the general framework of the Brazilian Internet Civil Framework (Law 12.965/2014) and the Consumer Protection Code (Law 8.078/1990).

Consequences of Misuse

Any use of the platform that subverts these elements — especially the introduction of financial rewards based on ranking positions by affiliates or users — constitutes a serious violation of these Terms and may subject the offender to sanctions provided under Law No. 14,790/2023 and Decree-Law No. 3,688/1941, for which the platform is not responsible.

4. Registration and User Account

4.1. Registration Requirements

Valid Email: Required for authentication and password recovery.
Responsible Information: When providing your first name, last name, nickname, or any name you wish to be called by, you agree not to use words that could be considered offensive, profanity, discriminatory terms, or aggressive language of any kind. We remind you that our platform is an inclusive space, with people of diverse gender identities, ethnicities, ages, beliefs, and cultures, and everyone must be treated with respect and dignity.

4.2. User Responsibilities

→ Password Security: You are responsible for maintaining the confidentiality of your password.
→ Account Activities: You are responsible for all activities performed on your account.
→ Unauthorized Access Notification: Notify us immediately of any unauthorized use.
→ Data Update: Keep your registration information up to date.
→ Purpose: Do not use the account for illegal activities, including money betting, organizing gambling or any improper commercial use of the platform.

Deadline for New Registrations

There is no deadline for creating new accounts, but users who register after a match has started will not be able to register predictions for that match, even if it is still in progress. They will start scoring from the next matches. The same applies to podium predictions, which will have a deadline and will be available on the specific page for that purpose.

However, for the purchase of Premium access, the deadline will be the start of the last Round of 16 match, on July 7 at 1:00 p.m. (local match time).

5. Prediction Rules

5.1. Submission Deadlines

Must be registered before each match's start time (stadium local time). After kickoff, predictions are automatically locked.

🏆 Podium Predictions

Champion, Runner-up, and 3rd place predictions must be submitted by the deadline specified on the dedicated page. After that moment, it will not be possible to choose or edit the podium.

5.2. Prediction Modification

✓ You can modify your predictions as many times as you want before the deadline.
✗ After the deadline, no changes are allowed (system locked).
ⓘ Automatic save when filling in scores (no need to click "Save").

5.3. Validation and Scoring

Automatic Calculation: Points are calculated automatically after each match ends. There may be a small delay due to unforeseen circumstances, but once resolved, the update will be performed.

Empty Predictions: Matches without registered predictions result in 0 points.

Tiebreak Criteria: In case of a tie, the order of tiebreak criteria among Premium participants with the same score will be as follows: Champion, Runner-up, 3rd place, Exact scores, and Correct results.

Absolute Prohibition: Rankings Do NOT Generate Prizes

The ranking is purely recreational and competitive among friends. There is NO prize, financial reward or any monetary benefit linked to ranking position or number of correct predictions, under any circumstances.

Examples of PROHIBITED Situations

❌ "Whoever gets the most games right wins"

Permitted Alternatives

✅ Random draw among active participants (not linked to performance)
✅ Symbolic recognition with no financial value
✅ Friendly competition solely for the pleasure of participating

Legal Justification

Linking prizes to prediction rankings may characterize the platform as a prize-based forecasting game, subjecting it to applicable gambling regulations or ranking as a criminal offense. This restriction ensures the platform maintains its exclusively recreational nature.

Prediction Transparency

Premium users can view the predictions of other participants in the lists they belong to after matches start and after the deadline for podium predictions, promoting transparency and fun among friends, preventing copying and ensuring a fairer and more enjoyable competition.

RECREATIONAL NATURE: The scoring system is transparent and public to ensure fair and friendly competitions. Points have no monetary value and are exclusively for entertainment among participants.

6. Payments and Premium Access

WHAT IS PREMIUM ACCESS?

Premium Access is an OPTIONAL purchase that offers extra features to enhance your recreational experience on the platform.

★ Unlimited Lists: Create as many recreational lists as you want to organize competitions with different groups (neighbors, friends, coworkers and family members who are also Premium)
★ Visual Customization: Play with colors and customize the platform to your liking
★ Ranking: Get full access to competition standings, including your position worldwide, in the European Union, by continent and by country

⚠️ IMPORTANT CLARIFICATIONS:

🎯 Premium DOES NOT provide competitive advantages in the game (everyone earns the same points for correct predictions)
💰 The payment is ONE-TIME (not a monthly subscription) and grants access throughout the tournament
🎮 Premium = extra entertainment features, not for betting or financial gain
🚫 Premium DOES NOT turn the platform into a betting house or gambling service
💳 Premium Access Price: The Premium access price may be changed at any time for new subscribers. Changes do not affect access that has already been purchased

6.1. Payment Model

Single Payment: Premium access requires a one-time (non-recurring) payment valid until July 31, 2026.

→ No Subscriptions: There will be no monthly charges or automatic renewals.
→ Accepted Currency: BRL (Brazilian Reais).
→ Payment Gateway: Asaas and Stripe.
→ Attention: The payment is for access to extra entertainment features, not for betting or gambling.

6.3. Refund Policy and Chargeback Prevention

Important Notice

Considering the digital, immediate, and irreversible nature of access to the Premium service, refunds are strictly limited to the cases described below:

Refund Conditions

1. Technical Error

Applicable exclusively in cases of:

• Proven failure in payment processing;
• Duplicate charge for the same user and referring to the same Premium access.

Not applicable when the same person makes payments for two or more distinct users, even if using the same payment details and/or payment methods.

Request deadline: up to 30 (thirty) days from the transaction date.

2. Service Not Activated

If Premium access is not granted within 72 (seventy-two) hours after payment confirmation.

Request deadline: up to 30 (thirty) days from the transaction date.

No Refund After Exercise of the Right of Withdrawal

Pursuant to Article 49 of the Brazilian Consumer Protection Code (Law No. 8,078/1990), the right of withdrawal within 7 (seven) days is fully guaranteed and is deemed fully satisfied through the complete availability of Premium features during the free trial period.

By using the trial period and subsequently choosing to purchase Premium access, the user declares that they have fully exercised their right of evaluation and withdrawal, acknowledging that:

The service is digital in nature and performed immediately;
Access is granted instantly and consumed irreversibly;
There is no technical possibility of "returning" the used service.

Therefore, no refund will be granted after payment confirmation, except in the expressly provided cases of Technical Error or Service Not Activated.

Strict Chargeback Policy

The user agrees that initiating a chargeback with the card issuer, financial institution, or payment processor without prior contact with the platform support constitutes a violation of these Terms of Use.

If an improper chargeback is identified, especially after:

• Full use of the free trial period;
• Voluntary confirmation of Premium subscription;
• Effective use of the service;

The following immediate and irrevocable measures will be adopted:

Immediate suspension of Premium access
Permanent restriction on future payments on the platform
Adoption of appropriate legal measures to recover material and financial damages

The user acknowledges that chargebacks generate:

• Direct financial losses to the platform;
• Administrative fees and penalties;
• Risk of blocking or restriction by payment intermediaries;
• Reputational damage and risk of suspension of essential financial services for platform operation.

In the event of an improper chargeback, the platform may:

• Judicially collect the principal amount plus charges, administrative fees, court costs, and legal fees;
• Register the default through legally permitted means;
• Use access records, logs, and proof of service usage as evidence of service consumption.
• Prevent the deletion of the account, retaining the stored data and records for possible submission to the competent authorities or for the adoption of appropriate measures aimed at recovering the improper chargeback.

A chargeback after use of the trial period will be considered presumably improper, resulting in immediate suspension of access while the case is reviewed. If the absence of a valid technical justification is confirmed, the suspension becomes permanent.

Mandatory Procedure Before Any Dispute

Before requesting any chargeback from the card issuer, the user must MANDATORILY contact the platform’s official support for an attempt at an administrative resolution.

Our commitment is to resolve any issues quickly, transparently, and fairly.

Opening a direct chargeback without prior contact will be interpreted as an abusive measure when service usage is proven.

7. User Conduct and Acceptable Use

By using the Platform, you agree NOT to perform the following actions:

Especially Affiliates:

❌ Present the platform as a betting tool
❌ Create "paid premium leagues"
❌ Charge for access to the Affiliate Premium List
❌ Use betting-related language in marketing

Prohibited Technical Use

✗ Use bots, scripts, or automations
✗ Attempt to access restricted system areas
✗ Reverse engineer the code
✗ Overload or interfere with servers
✗ Conduct DDoS attacks or similar
✗ Exploit security vulnerabilities

Prohibited Behavior

✗ Create multiple accounts
✗ Share access credentials
✗ Use offensive or inappropriate names
✗ Attempt to fraud the scoring system
✗ Request chargebacks
✗ Violate third-party rights

Consequences of Violations

Violation of these rules may result, at our sole discretion, in:

Responsibility for External Activities

The SÓ PITACO platform does not organize, intermediate or participate in any external activities. It is strictly prohibited to use SÓ PITACO as a basis for organizing:

Prohibited Activities Outside the Platform

🚫 Paid groups (VIP WhatsApp, Premium Telegram, paid Discord) using the platform as a base
🚫 Sale of predictions, analyses or sports consulting linked to SÓ PITACO
🚫 Pools, competitions with entry fees or money bets
🚫 Any commercial activity or monetization based on use of the platform

Platform Disclaimer

The SÓ PITACO platform has no control, participation or responsibility over activities carried out outside the official environment. Any external initiative is the sole responsibility of its organizers.

Responsible Use of the Platform

SÓ PITACO is a recreational entertainment platform. If you notice that its use is negatively affecting your personal relationships, daily routine, or well-being, we recommend taking a break. Account deletion is available at any time through the Control Panel → Risk Area → Permanently Delete Account.

7-A. Liability for Misuse Related to Betting

1 User Assumption of Responsibility

Any user who uses information, rankings, lists, or any data generated by the platform as a basis to organize, intermediate, or participate in informal or formal betting — with or without monetary prizes, regardless of the terminology used ("paid pool", "competition with prizes", "paid tournament", or any other) — assumes full and exclusive civil, administrative, and criminal responsibility for the acts performed.

2 Examples of Misuse (non-exhaustive)

(a) Charging any amount from third parties to participate in a list created on the platform while offering compensation based on ranking position.
(b) Using the scoring generated by the platform as the determining criterion for distributing monetary prizes or goods with economic value.
(c) Promoting or commercializing access to platform lists as if they were betting systems or paid prediction services.

Communication to Authorities

The platform reserves the right to report to the competent authorities — including SECAP/MF, the Civil Police, and the Public Prosecutor’s Office — any conduct that, based on the platform’s resources, may constitute a potential violation of Law 14.790/2023 or Article 50 of Decree-Law 3.688/1941, without such communication implying any acknowledgment of responsibility by the platform for the reported acts.

8. Intellectual Property

8.1. Platform Content

All content available on the Platform, including but not limited to:

Source code and structure
Design and visual layout
Logos and graphic elements
Texts and documentation
Algorithms and functionalities
Trademarks (if applicable)

Is the exclusive property of the Platform or its licensors and is protected by copyright laws, trademarks, and other intellectual property laws.

8.2. Your Usage Rights

• Share Platform links on social media
• Create lists on Premium and invite friends

❌ You CANNOT:

• Copy, modify, distribute, or create derivative works
• Use content for commercial purposes without authorization
• Remove copyright notices or trademarks
• Replicate the Platform or create similar services

Authorization for Use of Name, Nickname, and Score

• By participating in the platform and appearing in rankings, the user grants free authorization for the disclosure of their registered name or nickname and respective score on the platform, in rankings, lists, and any promotional materials of SÓ PITACO, in any media, in Brazil and/or abroad. The user may change their name or nickname at any time in the Control Panel.

8.3. Disclaimer from Official Events and Entities

Independent and Unofficial Project

SÓ PITACO is an independent project developed for recreational purposes and has no connection, authorization, partnership or affiliation with sports federations, competition organizers or official football entities.

Non-Affiliation Statement

We are not affiliated with, authorized by or endorsed by any national or international sports federation
We do not hold any license, partnership or commercial agreement with sports competition organizers
We do not represent football clubs, athletes, agents or any entity related to professional football
We do not sell official products, tickets or any material licensed by sports entities
We do not use registered trademarks of sports entities in an unauthorized manner or in a way that suggests an official partnership

Informational Use

Any reference to competitions, teams or sports results is made exclusively for informational and recreational purposes, within the right to freedom of expression and information.

9. Limitation of Liability and Disclaimers

IMPORTANT - READ CAREFULLY

The Platform is provided "AS IS" and "AS AVAILABLE", without warranties of any kind. To the maximum extent permitted by applicable law:

We do NOT guarantee that:

⚠ Results obtained will be accurate or reliable 100% of the time
⚠ Defects will be corrected within specific timeframes

9.2. Exclusion of Liability

We are NOT responsible for:

💰 Value Limitation

Under no circumstances shall our total liability for any damages exceed the amount paid by you for Premium access (if applicable).

10. Account Suspension and Termination

10.1. Termination by User

You may terminate your account at any time through the Control Panel:

Deletion is immediate, permanent, and irreversible
No refund of the amount paid for Premium access
Personal data will be deleted according to Privacy Policy

10.2. Termination by Us

We reserve the right to suspend or terminate your account, at any time and without prior notice, if:

• Fraud, chargeback, or illegal activity
• Use of unauthorized bots, scripts, or automations
• Attempt to compromise Platform security

• Platform discontinuation, which will occur on July 31, 2026

📋 Termination Effects

After account termination (for any reason):

→ You lose immediate access to all features
→ Predictions, points, and rankings are permanently deleted
→ Lists created by you are removed
→ Payment data is kept only for tax purposes (5 years)

11. Modifications to Terms of Use

We reserve the right to modify these Terms at any time. Changes take effect immediately upon publication on the Platform.

How you will be notified:

13. Applicable Law and Jurisdiction

13.1. Applicable Law

These Terms are governed by the following legislation:

General Data Protection Law (LGPD) - Law No. 13,709/2018 (Brazil)
Internet Civil Rights Framework - Law No. 12,965/2014 (Brazil)
Consumer Protection Code - Law No. 8,078/1990 (Brazil)
Brazilian Civil Code - Law No. 10.406/2002 (Brazil)
Law 14.790/2023 (fixed-odds betting) — cited exclusively to clarify that the platform is NOT a betting operator, does not fall within the licensing criteria of SECAP/MF, and does not offer financial returns based on the outcome of sports events.
Decree-Law No. 3.688/1941 (Criminal Misdemeanors Law, Article 50) — referenced to define what the platform expressly does not engage in.

For INTERNATIONAL users (Non-Brazilians): EXCLUSIVELY the jurisdiction of the District of Belo Horizonte, Minas Gerais, Brazil is elected, with EXPRESS WAIVER of any other jurisdiction (National or international).

If you are accessing this platform and ARE NOT BRAZILIAN, by creating an account or making a payment, you EXPRESSLY DECLARE AND AGREE that:

• Any and all disputes, controversies, or demands, judicial or extrajudicial, arising from this access, use, or payment, will be resolved exclusively before Brazilian courts;
• You expressly waive any foreign forum or jurisdiction, including that of your country of origin or residence;
• You accept that Brazilian legislation — including, but not limited to, LGPD (Law No. 13,709/2018), Consumer Protection Code, and Internet Civil Rights Framework — will be the only applicable legislation;

14. General Provisions

14.1. Entire Agreement

These Terms, together with the Privacy Policy and the Affiliate Program Terms (if applicable), constitute the entire agreement between you and the Platform, replacing all prior agreements, whether written or oral.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force. The invalid clause will be replaced by another that best reflects the original intent.

14.7. Deadline for Claims

Situations not expressly provided for in these Terms will be reviewed and decided by the SÓ PITACO platform at its sole discretion, taking into account the principles of good faith, reasonableness, and the recreational purpose of the platform.
